eBay Faces Patent Infringement Lawsuit

Online auctioneer eBay is being sued by a software developer which maintains a program that lets eBay users post auction listings infringes on its patented technology.

Online auctioneer eBay is being sued by a software developer which maintains a program that lets eBay users post auction listings infringes on its patented technology.

Network Engineering Software filed the suit late Thursday in a San Jose, Calif., federal court. The company is seeking unspecified damages and an injunction against eBay.

Robert Irvine, an attorney representing NES, said in published reports his client is not charging that eBay is using the exact same software code. He said NES believes eBay is using third-party software with technology that infringes on NES' patent.

eBay could not be reached to comment on the lawsuit.
